3.乙方交付的货物不符合合同规定的，甲方有权拒收，乙方向甲方支付该设备金额5%的违约金并按本合同第十条采取相应的解决措施。

4.甲方无正当理由拒收货物的，甲方向乙方支付合同金额3%的违约金。

5.乙方未能交付货物，则向甲方支付该设备金额10%的违约金。甲方有权就该货物或全部货物解除本合同。
